Welcome to Daily Trivia! These Terms of Service ("Terms") govern your access to and use of the Daily Trivia website, apps and services (collectively, the "Service"). By using the Service you agree to these Terms. If you don't agree, please don't use the Service.

1. Eligibility & Accounts

You must be at least 13 years old to use Daily Trivia. If you're under 18, you should have a parent or guardian's permission. You can play most of the game without an account. If you create one, you're responsible for keeping your credentials safe and for all activity that happens under it. Notify us right away at hello@dailytrivia.ai if you suspect unauthorized access.

2. Use of the Service

You're free to use Daily Trivia for personal entertainment! Here's what we ask:

  • Play fairly and don't try to cheat or hack the system
  • Don't use bots or automated tools to play quizzes
  • Keep your custom quiz submissions appropriate and family-friendly
  • Don't try to overwhelm our servers or disrupt other users' experience
  • Don't attempt to reverse-engineer, scrape, or resell our question bank
  • Don't use the Service to violate any law or infringe anyone's rights

3. Intellectual Property

The trivia questions, site design, and our adorable branding belong to us or our content partners. You can:

  • Share your scores and brag about your trivia skills
  • Take screenshots for social media (we love the free promotion!)

But please don't copy our questions for commercial use or try to recreate our site elsewhere. All Daily Trivia trademarks, logos and brand elements are our property and may not be used without written permission.

4. User-Generated Content

When you submit custom quiz topics, nicknames, or other content, you grant Daily Trivia a worldwide, non-exclusive, royalty-free license to store, display and use that content to operate and improve the Service. You represent that you have the right to submit anything you post and that it does not violate any law or third-party right.

5. AI-Generated Content Disclaimer

Quiz questions on Daily Trivia are generated by AI and validated against sources, but no automated system is perfect. Occasionally a question may be inaccurate, out-of-date or ambiguous. Daily Trivia is intended for entertainment and general knowledge, not as an authoritative reference. If you spot an error, please let us know.

6. User Conduct

We're all about good vibes here! When using Daily Trivia:

  • Be respectful in any user-generated content
  • Don't submit offensive, inappropriate, or harmful quiz topics
  • No spam, no harassment, just good clean fun
  • If you find a bug, let us know instead of exploiting it

7. Advertising

The Service may display advertising, including from Google AdSense. Ads are labeled where required. See our Privacy Policy for details on how advertising cookies are used and how to opt out of personalized advertising.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free or that any information will be accurate.

9. Limitation of Liability

To the maximum extent permitted by law, Daily Trivia and its operators will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred US dollars (USD $100) or the amount you paid us in the last twelve months, whichever is greater.

10. Indemnification

You agree to defend and indemnify Daily Trivia from any claims, damages or expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms.

11. Termination

We hope you'll stick around forever, but either of us can end this relationship at any time. If you violate these terms in a serious way, we might need to restrict your access. Don't worry though - we're pretty reasonable and will only do this if absolutely necessary. You can close your account at any time by emailing us. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will remain in effect.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.

13. Changes to Terms

As Daily Trivia grows and evolves, we might need to update these terms. We'll post any changes here with a new effective date. Major changes will be communicated clearly, but it's always good to check back occasionally. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
